Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of this website (the “Site”), operated by 503 Pharmacy Network (“503 Pharmacy Network”, “we”, “us” or “our”), a network of independent, state-licensed 503A compounding pharmacies. By accessing or using the Site, or by submitting a partnership inquiry, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. Who the Site is for

The Site provides information about pharmacy partnership services for licensed healthcare organizations, including clinics, medical practices, medspas and telehealth companies, and their authorized representatives. It is not intended for patients, and nothing on the Site creates a pharmacist–patient or physician–patient relationship. By submitting an inquiry you represent that you are at least 18 years old and are authorized to act on behalf of the organization you name.

3. No medical advice; prescriptions required

Content on the Site is provided for general informational purposes only and does not constitute medical, pharmaceutical or legal advice. Compounded medications are prepared by the pharmacies in our network only pursuant to a valid prescription from a licensed prescriber for an individual patient, in accordance with Section 503A of the Federal Food, Drug, and Cosmetic Act and applicable state law. Compounded medications are not FDA-approved, and their safety and effectiveness have not been evaluated by the FDA. Prescribers are responsible for their own clinical decisions.

4. Availability of services

Pharmacy services are provided only where legally permitted. Descriptions of licensing, shipping coverage, compounding capabilities, formulations, prescription workflows and integrations are general and subject to confirmation during onboarding. Availability may vary by state, medication category and the member pharmacy serving your practice, and may change without notice. Submitting an inquiry does not create a partnership, supply agreement or any other binding commitment; any partnership is governed by a separate written agreement.

5. Partnership inquiries and communications

By submitting the inquiry form you consent to being contacted by 503 Pharmacy Network and its member pharmacies by phone and email about your business inquiry. You agree to provide accurate information and to keep it up to date. You may ask us to stop contacting you at any time by emailing partners@503pharmacynetwork.com.

6. Acceptable use

You agree not to: use the Site for any unlawful purpose; submit false, misleading or automated inquiries; attempt to gain unauthorized access to the Site, its servers or any connected systems; interfere with the Site’s operation; or copy, scrape or reproduce the Site’s content for commercial purposes without our written permission.

7. Intellectual property

The Site and its content, including text, graphics, logos, the 503 Pharmacy Network name and wordmark, and the design of the Site, are owned by or licensed to 503 Pharmacy Network and protected by copyright, trademark and other laws. You may view and print pages for your organization’s internal evaluation of our services. All other use requires our prior written consent.

8. Third-party services and links

The Site may link to or rely on third-party websites and services, including those of our member pharmacies. We do not control and are not responsible for third-party content, products or privacy practices. Your use of those services is subject to their own terms.

9. Disclaimer of warranties

The Site is provided “as is” and “as available”. To the fullest extent permitted by law, 503 Pharmacy Network disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by law, 503 Pharmacy Network, its member pharmacies and their respective owners, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunity, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless 503 Pharmacy Network and its member pharmacies from any claims, damages, losses and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the Site.

12. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.

13. Changes to the Site and these Terms

We may modify or discontinue the Site, and may update these Terms, at any time. The “Last updated” date at the top of the page shows when the Terms were most recently revised. Your continued use of the Site after a change means you accept the updated Terms.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and 503 Pharmacy Network regarding the Site.
